Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LogoCrafter mobile application, website, and related services (collectively, the "Service"), operated by Ebaqdesign LLC ("we", "our", "us"). By using the Service, you agree to be bound by these Terms.

1. Use of the Service

You may use LogoCrafter to generate and download logo designs and related assets for personal or business use, subject to these Terms and any applicable license rules presented in the App.

You agree not to use the Service for any unlawful, harmful, or abusive purpose, including but not limited to:

• Creating content that is illegal, hateful, or discriminatory.
• Attempting to reverse engineer or misuse the Service.
• Infringing on the intellectual property rights of others, including existing trademarks or logos.

2. Accounts and Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. You are responsible for maintaining the security of any device or account used to access the Service and for all activity that occurs under your account.

3. Purchases and Subscriptions

Certain features of LogoCrafter, such as vector exports or premium mockups, may require a one-time purchase or subscription. Payments are processed by third-party providers such as Google Play, the Apple App Store, RevenueCat, or Stripe, and are subject to their terms and policies.

All prices and billing terms are displayed in the App or on the website at the time of purchase. Except where required by law, we do not offer refunds once digital content has been delivered or a subscription period has started.

4. License and Ownership

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the logos and assets you export from LogoCrafter for your own branding and marketing purposes.

You are solely responsible for ensuring that your use of any generated logo does not infringe on the rights of third parties, including existing trademarks or brand identities. We do not guarantee the uniqueness or registrability of any logo.

All rights in and to the Service, including software, design, and content (excluding your generated outputs), are owned by Ebaqdesign LLC or its licensors and are protected by intellectual property laws.

5. Generated Content and AI Services

LogoCrafter uses third-party AI services to generate logos and other assets based on your prompts and inputs. By using the Service, you grant us the right to process your prompts and generated content for the purpose of providing and improving the Service.

We may temporarily store generated images and prompts to allow you to view, regenerate, or save your designs. We do not use your content to train public models without your consent.

6. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that:

• The Service will be uninterrupted or error-free.
• Generated logos will be unique, legally available, or suitable for trademark registration.
• The Service will meet your specific expectations or business needs.

7. Limitation of Liability

To the maximum extent permitted by law, Ebaqdesign LLC and its directors, employees, and partners shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us for the Service in the six (6) months preceding the claim.

8. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or used the Service in a way that may cause harm to us or others. You may stop using the Service at any time. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitations of liability) will continue to apply.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after changes become effective means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict of law principles. Any disputes arising out of or relating to the Service shall be brought in the courts located in New York, New York, unless applicable law requires otherwise.
